Terms & Conditions

These Terms & Conditions provide a clear framework for the relationship between Bespoke Letter Writing Services and its clients.

1. The service

We provide bespoke writing and drafting services.

The service is based on information supplied by the client.

The client remains responsible for the factual accuracy of information supplied and for deciding whether and how to use the completed letter.

2. Scope and price

The principal bespoke letter-writing service is £49, subject to the agreed scope.

Other services may be available from £29, £79 or £99+, depending upon the nature, length and complexity of the assignment.

Any material additional work will be discussed and agreed before it is undertaken.

3. Client responsibilities

The client must provide accurate and sufficient information and must not knowingly ask us to create false, misleading, defamatory or unlawful content.

The client remains responsible for checking the factual accuracy of the completed letter and for deciding whether, when and how the letter should be sent or otherwise used.

4. Review and amendments

The client will have a reasonable opportunity to identify factual errors and request amendments within the agreed scope.

Requests that amount to a new or substantially different assignment may be quoted separately.

5. No specialist professional advice

Our service is not a substitute for legal, medical, financial or other regulated professional advice.

We may decline or limit an assignment where specialist advice is more appropriate.

6. Confidentiality and data protection

Client information will be handled in accordance with our Privacy Notice and applicable data protection law.

7. Outcomes

We do not guarantee that a recipient will agree with, accept or act upon a letter.

Our responsibility is to provide the agreed writing service with reasonable care and skill.

8. CANCELLATION AND WORK COMMENCING DURING THE 14-DAY PERIOD

Where the statutory 14-day cancellation period applies, the client will normally have a right to cancel the contract during that period, subject to applicable law.

The client may, however, expressly request that Bespoke Letter Writing Services begins work before the end of that period.

Where the client makes such an express request, the client acknowledges that work may commence immediately.

If the client subsequently cancels after work has begun, the client may be required to pay an amount proportionate to the service supplied up to the time the cancellation is communicated, where permitted by applicable law.

Where the service has been fully performed following the client’s express work-commencement request and acknowledgement during the cancellation period, the client’s statutory right to cancel may cease in accordance with applicable law.

Where work is requested during the cancellation period, the client’s express request and acknowledgement will be obtained in writing before work begins, as follows:

Express client request

“I request that Bespoke Letter Writing Services begins work immediately, before the end of my 14-day cancellation period, and I understand that if I cancel after work has begun, I may be required to pay for the service provided up to the point of cancellation.”

This request can be provided in writing by email or another agreed method before work begins.

9. TERMS AND CONDITIONS FOR CLIENT INDEMNITY AND RESPONSIBILITY

The client acknowledges that Bespoke Letter Writing Services prepares correspondence based substantially upon information, instructions, facts, documents and objectives supplied by the client.

The client therefore accepts responsibility for the accuracy, completeness and lawfulness of the information and instructions provided and for the client’s subsequent decision to send, publish, rely upon or otherwise use the completed letter.

To the extent permitted by law, the client agrees to indemnify and keep indemnified Bespoke Letter Writing Services, its proprietor, employees and contractors against reasonable losses, liabilities, claims, costs and expenses arising from any inaccurate, incomplete, misleading or unlawful information or instruction supplied by the client, or from the client’s use, publication or reliance upon the completed letter.

This indemnity does not apply to the extent that any loss, liability, claim, cost or expense is caused by the negligence, wilful misconduct or other liability of Bespoke Letter Writing Services which cannot lawfully be excluded or limited. Nothing in these Terms & Conditions is intended to exclude or restrict any liability or consumer right which cannot lawfully be excluded or restricted.

The client understands that a carefully written letter cannot control the actions, decisions or responses of its recipient. The client therefore remains responsible for deciding whether and how the letter should ultimately be used and acknowledges that Bespoke Letter Writing Services cannot guarantee any particular result or outcome.

10. LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to applicable law, Bespoke Letter Writing Services will not be responsible for consequences arising solely from inaccurate or incomplete information supplied by the client, the client’s failure to review the completed letter, or the client’s decision to use or send the letter in circumstances outside the agreed scope of the service.

Any liability of Bespoke Letter Writing Services will be considered subject to the agreed scope of work, applicable law and any relevant professional indemnity insurance arrangements.

11. Law governing our Terms and Conditions

These terms are intended to be governed by the law of England and Wales, subject to any mandatory consumer rights that apply.
